The owner of a dog allegedly tied to a fence with no shade, food or water at a West Lane Street home has been charged with aggravated animal cruelty.

Nathan Lee Holton, 31, of West Lane Street told Shelbyville police Queso, a type of dog known as an American Bully, was placed outside at 10 p.m. Tuesday. Holton said on Facebook he left for work around 9 a.m. Wednesday without checking on Queso. Holton’s wife was later told by a passerby Queso was allegedly showing signs of heat stroke.

Animal Control Officer Jon Evans responded to a call about Queso at 12:45 p.m. Wednesday and took him to an animal hospital for treatment. Holton turned himself in to authorities later in the day and posted $3,000 bond,

The dog was in critical condition Thursday, Evans said. Holton said on Facebook that Evans told him the “aggravated” charge was because he thought Queso’s life was in danger.

Holton said in Facebook comments Thursday the dog is normally not left tied.
